The King George County Board of Supervisors stood by its handling of the settlement of a legal dispute with Amazon Web Services during its meeting Tuesday night.
County Attorney Richard Stuart instructed Board Chair David Sullins to open the meeting with a statement regarding the settlement, which the county agreed to prior to a trial that was scheduled for Sept. 28.
In his statement, Sullins said that the agreement with AWS only settles a zoning dispute. Amazon filed the lawsuit in the spring of 2025 requesting that King George Circuit Court review the county’s board of zoning appeals’ March 2025 decision to deny the company’s request for a determination of vested rights to construct a data center campus on the 869-acre Birchwood Power facility property that it owns.
The county agreed that AWS has vested rights — legal rights or entitlements that are unconditionally secured and cannot be taken away without due process or the holder’s consent — in the settlement. In…
