Australia’s Federal Court has warned the legal profession of the dangers of using generative artificial intelligence in court proceedings and issued new rules for its use, with possible financial or legal consequences if AI errors thwart trials.
Amid a flood of court filings in Australia and around the world found to contain false citations generated by AI, the Federal Court on Thursday issued a new practice note on how the technology can be used in court proceedings.
Federal Court Chief Justice Debra Mortimer said submitting false or inaccurate information to the court was “unacceptable.”
“It is contrary to the responsibility of all persons not to mislead the court or other parties,” she said in the statement.
“It is also likely to frustrate the fair and lawful resolution of the process as quickly, cost-effectively and efficiently as possible.”
