Amazon has lost a legal battle against Perplexity after a U.S. appeals court overturned a temporary order that had blocked the AI company’s shopping tools from operating on Amazon’s platform.
The ruling, issued Tuesday, August 4, 2026, is an important early legal test for agentic AI — systems that can browse websites, make decisions and complete tasks on behalf of users.
What Happened Between Amazon and Perplexity?
Amazon sued San Francisco-based Perplexity in November 2025, accusing the AI startup of allowing its Comet browser and AI agent to access Amazon customer accounts without authorization.
Amazon argued that the technology created security risks and violated federal computer-access laws. Perplexity disputed the claims and said Amazon was attempting to prevent customers from using AI tools to shop on its platform.
Amazon Initially Won a Temporary Ban
A federal judge in California temporarily blocked Perplexity’s agentic AI tools from operating on Amazon in March 2026.
The lower court found that Amazon had presented strong evidence supporting its claim that Perplexity’s AI agent could violate the federal Computer Fraud and Abuse Act. The order was preliminary, meaning it did not represent a final decision on the underlying lawsuit.
