The court is conducting a Tunney Act proceeding to evaluate whether the settlement is in the public interest. “[T]The Tunney Act demonstrates Congressional recognition that the decision-making process that resulted in a proposed final sentence may be relevant to determining whether the sentence serves the public interest, but primarily to the extent that the process bears on the appropriateness of the proposed sentence. Applying this principle, it is clear that at least some of the discovery that the states have requested is appropriate and proportionate to the needs of the case,” said District Judge P. Casey Pitts.
