The Federal Circuit and Family Court of Australia (FCFCOA) has referred a lawyer to the South Australian Legal Profession Conduct Commissioner and two lawyers to the Victorian Legal Services Board for submitting material generated by artificial intelligence (AI).

The lawyer, known only as Ms. G, was also ordered to pay the defendants $10,000 in costs incurred as a result of the AI ​​errors created.

Justices Murray Aldridge, Catherine Carew and Juliet Behrens said it was in the public interest for regulators to be “aware of examples of difficulties created by the use of AI”.

Citing guidelines from the FCFCOA and other courts, the bench said that when AI is used to identify authorities for the purposes of a court document, “it is incumbent upon the author and those assuming responsibility for the document to verify that those authorities are both accurate and relevant to the document…”
