The review under the Tunney Act procedure will determine whether the settlement was in the public interest, but states are seeking to examine the settlement process, which they say is tainted by undue influence. U.S. District Judge P. Casey Pitts noted, however, that the ultimate focus of the Tunney Act review is primarily the substance of the settlement and its impact on the market.
