Federal Circuit reinstates patent infringement lawsuits against Nokia, ADVA, and Cisco

The United States Court of Appeals for the Federal Circuit has revived patent infringement cases against tech giants Nokia, ADVA, and Cisco filed by Core Optical Technologies. The appeals court overturned a ruling by the United States District Court for the Central District of California, which had favored the defendants. The legal dispute stems from ambiguities surrounding invention agreements related to optical technology.

The California district court had previously ruled that the inventor of one of Core Optical’s patents did not develop the technology entirely on his own time, citing his fellowship at TRW, which was later acquired by Northrop Grumman. The court found the language of the invention agreement regarding the ownership of inventions created outside of work hours to be ambiguous, leading to the decision being overturned by the Federal Circuit.

Core Optical had accused Nokia, ADVA, and Cisco of infringing on a patent related to improving optical signaling techniques developed by Mark Core during his time at TRW. The defendants argued that Core had already assigned patent rights to TRW under a 1990 employment agreement, making the subsequent assignment to Core Optical invalid. The district court agreed with the defendants, but the Federal Circuit disagreed and emphasized the need for a closer examination of the facts.

The Federal Circuit highlighted the ambiguity in the interpretation of the employment contract and the criteria outlined in the TRW Inventions Agreement. The court noted that Core had conducted his doctoral research outside of TRW hours and without using TRW resources, contradicting the district court’s ruling. The ambiguity surrounding the application of the non-TRW invention clause necessitated further judicial review.

Despite a dissenting opinion from Circuit Judge Haldane Mayer, who argued that the benefits Core received from TRW constituted TRW resources, the Federal Circuit decided to vacate and remand the case for additional proceedings in the Central District of California. The decision allows Core Optical’s infringement claims against Nokia, ADVA, and Cisco to move forward.

The complexities of invention agreements and ownership rights in the technology industry have played a significant role in this legal battle. The Federal Circuit’s decision to overturn the district court ruling opens the door for further examination of the facts and a potential resolution of the patent infringement disputes between Core Optical and the tech giants.
