The US Department of Justice and the Federal Trade Commission have agreed to split investigations into potential antitrust violations by Microsoft, OpenAI, and Nvidia in the artificial intelligence industry. The DOJ will focus on Nvidia, while the FTC will look into OpenAI and Microsoft. The agreement, reached last week, follows a similar split in enforcement against Big Tech in 2019. Regulators are concerned about the concentration of power in the AI industry, with Nvidia commanding about 80% of the market for AI chips. Microsoft’s $650 million deal with Inflection AI is also under scrutiny for potential merger disclosure violations. The investigation into OpenAI was sparked by allegations of consumer protection law violations in relation to data privacy. US antitrust chief Jonathan Kanter has expressed concerns about the dominance of companies in AI due to their access to vast amounts of data and computing power. The regulators’ settlement highlights the increasing regulatory scrutiny on companies operating in the AI industry.
