An Australian worker could face a significant bill if they rely on inaccurate AI-generated information in a case before the Fair Work Commission (FWC).
The worker claimed he had been “constructively dismissed” by his employer, but his case was dismissed by Fair Work Commission (FWC) deputy president Nicholas Lake, who ordered the company to make a rare costs claim.
FWC applicants are generally protected from having to pay the other side’s legal costs, even if they lose the case.
But Lake found that the employee’s use of AI, which relied on completely fabricated information, was so egregious that he may now have to pay his former employer’s legal fees.
“I welcome an application for costs from the defendant in this matter,” Lake said in his findings.
