Federal Judge grants Endicott ability to sue IBM for water contamination

ENDICOTT, N.Y. (WBNG) — The Village of Endicott is moving forward with a lawsuit against IBM after a federal judge ruled in favor of the village’s ability to proceed.

Endicott is accusing IBM of contaminating its groundwater and municipal wells with substances including 1,4-dioxane and PFAs.

“They use this in their processing and their semiconductor industry,” said Stephen Acquario, the attorney representing the Village. “Once they enter the groundwater, once they’re discharged into the environment, they are what’s known as a forever chemical. They don’t ever go away. And ultimately, as we’ve seen here in the village of Endicott, New York, they have hit the municipal water system.”

According to court documents, the village closed off wells 5 and 28 upon these findings, forcing them to purchase water from Johnson City at costs exceeding $1 million. Endicott later purchased a property to develop a new well at $12 million to restore the village’s water supply.
